JUSTICE RAKESH KUMAR ORAL ORDER 06-12-2016 Heard Sri Rajendra Prasad Sah, learned counsel for the petitioner, Sri Shyam Kumar Singh, learned Addl. Public Prosecutor as well as Sri Bimal Kumar, learned counsel, who has voluntarily appeared on behalf of the informant. The petitioner, who is a lady and in custody since 12.08.2016 in Barari P.S. Case No.199/2015 registered for the offence under Sections 147,148, 149, 307, 302, 504, 337, 338, 506 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that due to land dispute, alleged occurrence had taken place, in which allegation against the petitioner is of throwing bricks on the informant. In the said occurrence two persons died. In this case, earlier case diary was called for, which

Learned Addl. Public Prosecutor and Sri Bimal Kumar, learned counsel for the informant have vehemently opposed the prayer for bail of the petitioner. However, considering the nature of accusation as well as the fact that the petitioner is a lady, let the petitioner, namely, Kavita Devi be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.V, Katihar in connection with Barari P.S. Case No.199/2015. (Rakesh Kumar, J) NKS/- U T
