2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 and 34 of the Indian Penal Code.

3. The case of the prosecution is that on 13.06.2024 the mother of the informant got seriously ill when she recovered, the informant went to sleep. On 14.06.2024, at 5 AM, she found that there was blood on the head of her mother and her mother died. During course of investigation, it has come that the petitioner was having illicit relation with the informant which was being objected by the deceased due to which he has killed her. No.38502 of 2025(3) dt.03-09-2025 2/3 also arrested and she has given her confessional statement before police that she was having illicit relation with the petitioner which was being objected by her mother and due to which she has killed her mother by assaulting her with a hammer. It has also come that after the commission of the offence, the informant has made calls to the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Learned counsel for the petitioner has submitted that as far as the call details are concerned, according to the confessional statement of the informant itself, it is clear that she called the petitioner after the commission of the offence. There is nothing except the rumour that the petitioner was having illicit relation with the informant. Moreover, he is languishing in judicial custody since 13.11.2024.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with
