JUSTICE SUDHIR SINGH ORAL ORDER 08-05-2015 The petitioner is apprehending his arrest in connection with Belhar (Kheshar) P.S. Case No. 120 of 2014 for the offence under Sections 406, 409, 420 of the Indian Penal Code.

Heard learned counsel for the petitioner and the State.

The prosecution story, in brief, is that while the petitioner was posted as Sub-Postmaster, Sub-Post Office, Kheshar, Banka, he deceitfully and fraudulently withdrew Rs. 2,00,000/- from the account of one Subodh Kumar Kapri and Smt. Nutan Devi.

It is submitted on behalf of the petitioner that the petitioner is a Government employee and worked with the Postal Department. It has been alleged that the fake withdrawal, which is alleged to have been made by the

Patna High Court Cr.Misc. No.1213 of 2015 (3) dt.08-05-2015 petitioner, the same has been deposited by the petitioner. On behalf of the State, it has been submitted that the petitioner is named in the First Information Report. Further it has been stated on behalf of the counsel for the State that the fake withdrawal amount made by the petitioner has been deposited by the petitioner.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Banka in connection with Belhar (Kheshar) P.S. Case No. 120 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
