JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 498A of the Indian Penal Code.
On the joint prayer of the parties, the matter was referred to the Mediation Centre of the State Legal Services Authority. The report of the Mediator dated 8.1.2016 at Flag B reflects that the issue has been resolved between the parties. The complainant agreed to resume the conjugal life. The petitioner has given undertaking that he will neither assault the complainant nor will perform second marriage. On violation of the terms of
Patna High Court Cr.Misc. No.31539 of 2015 (4) dt.11-01-2016 2/2 agreement the petitioner will be subject to the legal proceedings and the petitioner will provide one room in the ancestral house to the complainant within a period of six months after making it habitable.
Learned counsel for the complainant does not dispute the factum of agreement and is not opposing the prayer of the petitioner for anticipatory bail.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhabua (Kaimur) in connection with Complaint Case No. 931 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
Needless to say, either side will be at liberty to file appropriate application in case the terms of settlement are violated.
