The petitioner seeks bail in Dalsingsarai P.S. Case No. 23 of 2017 registered for the offence punishable under Section 414 of the Indian Penal Code and under Sections 25(1-b)a/26/35 of the Arms Act.
Learned counsel for the petitioner submits that one stolen motorcycle along with other articles are said to have been recovered from possession of four persons. It is submitted that from perusal of the seizure list a mobile of Lava company with two SIM of Aircel and Airtel were recovered from possession of the petitioner and for that the petitioner is in jail since 25.01.2017. The petitioner has already remained in jail for 51⁄2 months. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition.
Patna High Court Cr.Misc. No.28691 of 2017 (2) dt.12-07-2017 2/2 Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur in Dalsingsarai P.S. Case No. 23 of 2017.
