The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 341, 323, 324, 307, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that petitioner assaulted Kishore Kumar with dabiya causing injury on head further Varun assaulted Kishore by brick on chest and they threw him in a pond from a bridge. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that petitioner and the victim were friends and
Patna High Court CR. MISC. No.40398 of 2022(2) dt.08-12-2022 2/2 they were sitting on a bridge and the victim fell from the bridge which led to injury, as alleged, it is also submitted that injuries suffered by the victim are simple in nature.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner and the fact that the injuries are simple, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with K. Nagar (Champa Nagar) P.S. Case No. 161 of 2022 subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
