Petitioner is languishing in custody since 07.09.2016 in connection with Bhagalpur G.R.P.S. Case No. 104 of 2016 corresponding to G.R. No. 104 of 2016 for offence punishable under Section 47(A) of the Bihar Excise (Amendment) Act, 2016 as well as Section 137 of the Railway Act. Six bottles each containing 375 ml. and 48 bottles each containing 180 ml. of foreign liquor was recovered from the possession of the petitioner on 06.09.2016. Petitioner has stated on oath that he has got no criminal antecedent.

Considering the quantity of recovery and period of custody of the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten
