JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kotwa P.S. Case No. 125 of 2010 registered for the offence punishable under Section 414 of the Indian Penal Code. The name of petitioner came in the statement of coaccused, who was arrested by the police on the spot and apart from this, petitioner carries criminal antecedent of similar nature which is evident from perusal of para-3 of the petition. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant the privilege of anticipatory bail to the petitioner and accordingly, his

Patna High Court Cr.Misc. No.29018 of 2015 (2) dt.28-07-2015 2/2 prayer for anticipatory bail in connection with Kotwa P.S. Case No. 125 of 2010 pending in the court of Shri Rajeev Kumar-IV, Judicial Magistrate 1st Class, Motihari East Champaran stands rejected.

However, if petitioner surrenders before the concerned court within four weeks from today and seeks regular bail, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
