Petitioner seeks bail in a case registered for the offences punishable under Sections 326, 307/34 of the Indian Penal Code as well as Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner is that he is in the habit of torturing his wife even to the extent of causing burn injury to her. The informant is father of the victim-girl. The victim is also present in Court and it is evident that she has sustained burn injury. In spite of that she is ready for restoration of conjugal life with the petitioner. Learned counsel for the petitioner submits that petitioner is also ready to keep his wife with full honour and dignity. Petitioner is in custody since 27.12.2017.

No.36525 of 2018 (4) dt.06-08-2018 2/2 Considering the readiness of the wife of the petitioner for restoration of conjugal life, let the petitioner, above named, be released on provisional bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ishipur (Barahat) Police Station Case No. 90 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.

The provisional bail shall be confirmed by the learned court below only after ensuring about the cordial restoration of the relationship.
