The petitioner is apprehending his arrest in connection with Supaul P.S. Case No. 191 of 2014 registered for the offences punishable under Sections 147, 148, 149, 323, 332, 337, 353 and 431 of the Indian Penal Code and 3/4 of the Public Property Act. Learned counsel for the petitioner submits that he is an employee of Railways and had come home on the said date. It appears that photography of the alleged occurrence had been taken and the petitioner has also been figured in the same and, as such, he can only be treated as a member of crowd.
Considering the aforementioned facts and circumstances and the fact that the petitioner has no criminal antecedent and has no play to the same, let the above named
Patna High Court Cr.Misc. No.30233 of 2015 (2) dt.05-08-2015 2/2 petitioner, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 191 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
