This is an application for bail in connection with Digha P.S.Case No. 52 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Petitioner is named in the FIR and the case is under Section 302 IPC.

Submission of learned counsel for the petitioner is that except suspicion there is nothing against the petitioner as deceased had gone along with the petitioner and other co-accused persons and later on his dead body was found and he is in custody since 15.3.2017.

Having heard both sides and in view of facts and

Patna High Court Cr.Misc. No.36737 of 2017 (3) dt.30-08-2017 2/2 circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Patna, in connection with Digha P.S.Case No. 52 of 2017, subject to the conditions that :- (i) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned, (ii) petitioner shall co-operate in trial and appear in court on each and every date fixed and on failure to appear without any genuine ground or without permission of court, his bail bond shall be cancelled.
