The petitioner has prayed for bail in connection with Delha P.S. Case No. 110 of 2019 registered for the offence under Sections 341, 323, 504, 506, 324, 308, 498(A) and 34 of the Indian Penal Code and Sections 37(c) of Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, the allegation against the petitioner and others, made by the informant is that her motherin-law, devar and other relatives started hurling abuses and thereafter altercation took place in the family. It is submitted by the learned counsel for the petitioner that minor altercation took place in the family due to provocation by the informant. Petitioner is brother-in-law

Patna High Court CR. MISC. No.38111 of 2019(2) dt.05-07-2019 2/2 (Devar) of the informant. He has no criminal antecedent and he is in custody since 30.04.2019.

The application for bail is opposed by the learned APP for the State.

Having heard the learned counsel for the parties and considering that the altercation has taken place due to some trivial dispute in the family, this Court is inclined to grant bail to the petitioner. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise) Gaya in connection with Delha P.S. Case No. 110 of 0219.
