The petitioners apprehend their arrest in a case under Section 379 and other sections of the Indian Penal Code and under Section 3 (1) (x) of S.C. and S. T. Act.
The informant made allegation that petitioner Jagdish Yadav abused him while he was returning after grazing his pig. He brought him to his house and thereafter other accused persons assaulted the informant.
It is submitted that there is counter version being Andhratharhi P.S. case No. 31/2014 and the case from the side of
Patna High Court Cr.Misc. No.30874 of 2015 (2) dt.30-07-2015 2/2 the petitioners was lodged earlier in point of time in which the informant assaulted the petitioners. The petitioners never abused the informant.
Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani in Andhratharhi P.S. Case No. 32 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
