The petitioner, who is in custody, seeks bail in connection with Chhatauni P.S. Case No. 233 of 2017 registered for the offence punishable under Sections 384, 387 of the Indian Penal Code.
Informant in his written complaint has alleged that on 14.09.2017 at about 9.50 PM he received a mobile call on his official mobile in which ransom of Rs. 10 lacs was demanded and by sending SMS also.
Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case. The mobile number from which ransom was demanded and SMS
Patna High Court Cr.Misc. No.36297 of 2018(3) dt.21-08-2018 2/2 was sent does not belong to him and he has been implicated in this case on the basis of his self confession and except it there is no other incriminating materials against him. Apart from this case, there is one more case instituted against the petitioner in which he is already on bail being Madhuban P.S. Case No. 247 of 2017 Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chhatauni P.S.
