The petitioner seeks bail in a case instituted under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
There is suspicion against the petitioner that he was also involved along with other co-accused persons in killing of the deceased.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.06.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Except for suspicion, there is no other substantive evident to suggest his implication in
Patna High Court Cr.Misc. No.50512 of 2016 (2) dt.22-11-2016 2/2 the present case. The other co-accused has been granted bail vide Annexure-2 to the present application.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Chainpur P.S.
