Petitioner seeks bail in a case registered for the offences punishable under Section 47(A) of the Bihar Excise (Amendment) Act, 2016 and Section 272 and 273 of the Indian Penal Code.

Forty litres foreign liquor was recovered from the bag of the petitioner at the railway station. Submission of the petitioner is that the petitioner is in custody since 26.08.2016 and possession of foreign liquor was not an offence on the date of recovery. Moreover, the petitioner has got no criminal antecedent.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.49894 of 2016 (2) dt.22-12-2016 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Khagaria/Successor Court in connection with Khagaria Rail P.S. Case No. 20 of 2016.
