The petitioner seeks bail in connection with Dinara P.S. Case No.41 of 2017 registered under Sections 272 and 273 of the Indian Penal Code besides Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that in course of patrolling duty, the informant and other police officials on receiving information about selling of the liquor by Bimlesh Singh alias Chandan Singh and this petitioner in village-Sorthi in a cabin reached there but both succeeded to flee away. On search of the cabin, 380 pouches, each containing 200 ml. country made liquor, 96 bottles, each

Patna High Court Cr.Misc. No.27984 of 2017 (4) dt.23-08-2017 2/2 containing 180 ml. Indian Made Foreign Liquor and 16 bottles, each containing 375 ml. Indian Made Foreign Liquor were recovered.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was not apprehended on the spot and on mere suspicion, he has falsely been implicated in this case. The petitioner having no criminal antecedent is in custody since 26.04.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Court, Excise, Rohtas, Sasaram, in connection with Dinara P.S. Case No.41 of 2017. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
