JUSTICE BIRENDRA KUMAR ORAL ORDER 28-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Complaint Case No.731 of 2010, a case under Sections 406/420/347/363A of the Indian Penal Code, pending in the Court of learned Additional Chief Judicial Magistrate-IV, Banka. The allegation is based on complaint petition. The petitioner, who is relative of the complainant, took her 16 years son for giving him a job. For few months rupees one thousand was paid to the complainant and thereafter the payment was stopped and the victim has still not been recovered. Petitioner is in custody since 14.04.2018.

Patna High Court Cr.Misc. No.37051 of 2018 (3) dt.28-08-2018 P2/ Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail is refused. The learned trial Court is directed to expedite the trial and conclude the same within nine months, failing which the petitioner would be at liberty to renew the prayer for bail before the trial Judge itself, who shall pass a reasoned order.
