The petitioner seeks regular bail in connection with Sasaram (Muff) PS case no. 182 of 2017 registered for the offences punishable under Section 395 of Indian Penal Code. The informant has alleged that while he was plying the truck on the road, some persons present on the road had caused the tyre of the truck to get punctured. The truck driver stopped the truck and started replacing the tyre. In the meantime, unknown accused persons, on pistol point, had taken the money and mobile phone from the informant.
Learned counsel for the petitioner submits that the petitioner does not have any criminal antecedent, no T.I.P. parade
Patna High Court Cr.Misc. No.30594 of 2017 (2) dt.06-07-2017 2/2 has taken place so as to connect the petitioner with the alleged occurrence and the petitioner is in custody since 18.02.2017. It has been further submitted that similarly situated co-accused person has already been granted bail by this Hon'ble Court vide order dated 01.07.2017 passed in Cr.Misc. no. 27290 of 2017. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Muff) PS case no. 182 of 2017.
