ANJANA MISHRA ORAL ORDER 14-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341, 323, 504, 506/34 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was added.
Learned counsel for the petitioner submits that the entire gamut of allegations made against the petitioner is false as the fact is that there is a postmortem report of the Patna Medical College and Hospital, Patna (Annexure-2) in which no external injury has been found to be present on the body of the deceased Leela Devi and the cause of death has been given to be CAV (i.e. Cerebro Vascular Accident) due to hyper tension leading to cardiac respiratory failure.
In view of the submissions as above, let the petitioner Lal
Patna High Court Cr.Misc. No.32285 of 2015 (2) dt.14-08-2015 P2/2 Babu, in the event of his arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Judicial Magistrate, 1st Class, Jehanabad in connection with Karpi P.S. Case No. 28 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
