The petitioner seeks regular bail in connection with Mahua PS case no. 11 of 2017 registered for the offences punishable under Sections 307, 324, 302/34 of Indian Penal Code and 27 of Arms Act.

The accusation is with regard to altercation having taken place between accused persons and informant side on account of personal feuds. Specific allegation of firing has been leveled against Vinod Singh and Baidnath Singh. Learned counsel for the petitioner submits that as far as petitioner is concerned, no allegation of any specific overt act has been leveled against him, he has clean antecedent and is in custody since 13.01.2017.

No.30604 of 2017 (2) dt.06-07-2017 2/2 Having regard to the facts and circumstances of the case, more particularly the fact that the petitioner is not the main accused and there being no allegation of any specific overt act of firing against him like that of aforesaid Vinod Singh and Baidnath Singh, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua PS case no. 11 of 2017.
