====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 27-08-2025 Heard learned senior counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in connection with Industrial Area P.S. Case No. 41 of 2025 dated 05.03.2025 registered for the offences punishable under Sections 318(4), 179,181 and 182 of the B.N.S., 2023.
3. As per the prosecution case, on 05.03.2025 at about 16.00 hours, police apprehended the co-accused Pintu Chaudhary and Pankaj Kumar Gupta (petitioner) from the car which was driven by the co-accused Pintu Chaudhary and Pankaj Kumar Gupta (petitioner) was sitting on the said car. It is further alleged that on search, one Laptop and two screen touch
Patna High Court CR. MISC. No.42777 of 2025(3) dt.27-08-2025 2/3 mobiles were recovered from the car, Rs. 25,000/- fake currency notes were recovered from the purse and jeans pant of the petitioner and Rs. 1550 original currency notes were recovered from the purse of the petitioner.
4. Learned senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner himself a victim in the present case who has received fake currency notes alongwith the genuine notes from his freelancing job and later on he was dragged in the present case. It is further submitted that the petitioner had no knowledge that the fake currency notes has been received by him and kept it believing it to be genuine. It is further submitted that had the petitioner been smuggling fake currency notes then he would have been in possession of more than 50 fake currency notes as he has to give the same to other people at very low cost to circulate in the market. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody in this case since 06.03.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.42777 of 2025(3) dt.27-08-2025 3/3 of the case as well as the period of custody, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Bhagalpur in connection with Industrial Area P.S. Case No. 41 of 2025 with further conditions:- (I) The petitioner is directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
(II). If the petitioner is found involved in similar nature of offence in future, his bail bond is liable to be cancelled.
7. The application stands allowed.
