Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code. The FIR of the occurrence of dacoity is against unknown. Petitioner is in custody since 09.09.2017. Submission is that nothing was recovered from possession of the petitioner nor the petitioner has got any criminal antecedent. Another co-accused has already been allowed bail in this case by a Coordinate Bench of this Court vide order dated 12.04.2018 passed in Cr. Misc. No. 13496 of 2018 (Annexure 2). Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the
Patna High Court Cr.Misc. No.34045 of 2018 (3) dt.14-08-2018 2/2 like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Case No. 107 of 2018 arising out of Katoria Police Station Case No. 147 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below.
