JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-09-2019 This application, for grant of anticipatory bail, arises out of C.I. Case No. 253 of 2018, disclosing offences under Section 30(a) read with Section 13 of the Bihar Prohibition and Excise Act.
Prosecution case is that on confidential information Excise officials conducted raid and recovered 8 litres of liquor from co-accused Guddu Kumar and petitioner succeeded in fleeing away.
Submission of learned counsel for the petitioner is that he has no criminal antecedent and has falsely been made accused in this case on the confession of co-accused and except that there is nothing against the petitioner. Learned counsel for the State opposed the prayer for
Patna High Court CR. MISC. No.46344 of 2019(3) dt.30-09-2019 2/2 anticipatory bail of the petitioner, however, he could not controvert the submission of petitioner that save and except confession of co-accused, there is nothing against the petitioner. Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.IIcum- Special Judge, Katihar, in connection with C.I. Case No. 253 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
