Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Amarpur (Fullidumar) P.S. Case No. 244 of 2020, registered for the offences punishable under Sections 341, 323, 307, 337, 379, 504, 506/34 of the Indian Penal Code. At the outset, learned counsel for the petitioners has submitted that the petitioner No. 2, Rajesh Tanti, has been

Patna High Court CR. MISC. No.50745 of 2021(2) dt.21-06-2022 2/3 arrested, as such, he wants to withdraw this anticipatory bail petition in respect of petitioner No. 2.

Accordingly, the anticipatory bail petition in respect of petitioner No. 2 is dismissed as withdrawn. As per allegation, the accused persons including the petitioners levelled allegation against the informant that he had informed the police about the address of the petitioners. The specific allegation against petitioner No. 1 Manish Tanti is that he assaulted the informant on his head with khanti and all the three accused persons assaulted his cousin Kamal Kumar and uncle Shankar Tanti. Kamal Kumar also became injured. Learned counsel for the petitioners has submitted that they are innocent having no criminal antecedents and the injury suffered by the informant and Kamal Kumar are simple in nature.

Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/ Successor Court, Banka in connection with Amarpur (Fullidumar) P.S.

Patna High Court CR. MISC. No.50745 of 2021(2) dt.21-06-2022 3/3 Case No. 244 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
