2. The petitioner is in custody in connection with Madhubani Town P.S. Case No. 503 of 2024 for the offence punishable under Sections 316(2), 318(4), 338, 336(3) and 340(2) of the B.N.S. lodged on 05.11.2024 by the informant, Gaurav Kumar.

3. As per the prosecution story, the petitioner while serving as a postal assistant at Madhubani Court Sub-Post Office misappropriated Rs. 10,12,281/-. Upon information, he deposited Rs. 2,25,781/- but chose to look the other way so far as Rs. 7,86,500/- is concerned, in that background, the FIR.

4. Learned counsel for the petitioner at the outset

Patna High Court CR. MISC. No.44473 of 2025(5) dt.15-11-2025 2/3 submits that some account difference was there, he got implicated, has remained in custody since 12.04.2025, has no criminal antecedent. Further, to make the record straight, he is ready to deposit Rs. 7,86,500/- in favour of the Superintendent of Post Offices, Madhubani Division, Madhubani.

5. Learned APP though opposes the prayer accepts the fact that now when the petitioner is ready to deposit the rest amount, has remained in custody since 12.04.2025, an appropriate order can be passed.

Taking into account the submission of the parties as also the aforesaid facts including his period of custody and has no criminal antecedent coupled with the fact that he is ready to deposit Rs. 7,86,500/- in favour of the Superintendent of Post Offices, Madhubani Division, Madhubani, in that background, this Court is inclined to extend him the privilege of bail with conditions.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Madhubani Town P.S. Case No. 503 of 2024 subject to the following conditions: (i) one of the bailor should be the family

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Adnan/- U T
