This application is for grant of regular bail in connection with Mahila P.S.Case No.44 of 2016 for the offences punishable under Sections 376, 313, 504/34 of the Indian Penal Code.

Allegation against the petitioner is of committing rape upon the informant on the assurance of marriage with her. Submission of the learned counsel for the petitioner is that he is still ready to marry with her and allegation is false and concocted.

Heard learned A.P.P. also as well as learned counsel for the informant. They have opposed the prayer for bail but the learned counsel for the informant has submitted that if the

Having heard both sides and in such view of the matter, this application is disposed of with direction to the court concerned to verify the fact that the petitioner is ready to marriage by calling upon the petitioner and the informant in the court itself and if he is satisfied, he will release the petitioner on provisional bail on his own satisfaction and once being satisfied with their marriage, he will confirm the bail. If he is not satisfied, he may pass any other order or orders as he may be deemed fit and proper. With the aforesaid observation, this application is disposed of.
