Allegation against the petitioner is that he caught hold of the deceased and co-accused Md. Nawab fired. Submission of learned counsel for the petitioner is that one accused Md. Nawab @ Mod. Nawab Gul @ Gul and other accused persons have been granted bail by different Coordinate Benches of this Court, vide order dated 12.04.2019 passed in Criminal Misc. No. 77772 of 2018 and order dated 15.01.2019 passed in Criminal Misc. No.77422 of 2018. Heard learned APP also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named,
Patna High Court CR. MISC. No.39147 of 2019(2) dt.11-07-2019 2/2 be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Bakhtiarpur P.S. Case No. 258 of 2018, with condition that he has to appear as and when required by the learned court below and once committed before learned Trial Court also, at the same time, learned court below is directed to expedite the commitment of the case and see that commitment is made within two months.
With the above observations, this application is allowed.
