2. The petitioner seeks regular bail in connection with S.Tr. No.1269 of 2023, arising out of Dhaka P.S. Case No.429 of 2023 lodged under Sections 413, 414/34 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against 17 named accused persons against whom there is allegation that they were caught by the police with the motorcycle which was subject to theft.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the police has apprehended three accused persons including the petitioner.

5. Counsel further submits that the offence under

Patna High Court CR. MISC. No.46020 of 2024(3) dt.30-08-2024 2/2 which the petitioner has been charged, is magisterial triable in nature.

6. Counsel further submits that the petitioner is in custody since 27.07.2023 and there is one criminal case pending against him in which he is on bail.

7. Learned counsel for the State opposes the prayer for bail.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on being satisfied by the trial court that the petitioner is not absconding in the case i.e., Pakridayal P.S. Case no.158 of 2023 which is pending against him, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-13, East Champaran in connection with S.Tr. No.1269 of 2023, arising out of Dhaka P.S. Case No.429 of 2023, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
