2. The petitioners are apprehending arrest in connection with Nokha P.S. Case No. 442 of 2024, dated 24.11.2024, lodged under Section 191(2), 190, 126(2), 115(2), 303(2), 352, 351(2), 351(3) of the Bhartiya Nyaya Sanhita, 2023 (hereinafter referred to as "BNS, 2023"). Later on Section 109 of the BNS is also added.
3. As per the prosecution, FIR has been lodged against 13 named accused persons, including the present petitioners. It

No.39024 of 2025(2) dt.25-06-2025 2/3 is alleged that on 24.11.2024, the informant went to his land to guard it and, upon noticing the presence of the accused persons, he protested. In response, the accused persons verbally abused him. The informant then called his son, Ravi Kumar, and his nephew, Rupesh Kumar, for support. Subsequently, all the accused persons assaulted them using lathis and danda sticks. During the assault, the informant, his son, and Rupesh Kumar sustained internal injuries. It is further alleged that, in the course of the scuffle, the accused persons snatched a gold ring from Rupesh Kumar and Rs. 2,000/- in cash.
4. Learned senior counsel for the petitioners submits that the petitioners are innocent and have committed no offence. He further submits that from the contents of the FIR, it becomes crystal clear that a land dispute is ongoing between the parties, and after the sale of a portion of the said land by the family members, the present dispute arose with the informant. Senior counsel further submits that both parties are well known to each other, and the entire scuffle took place due to the said land dispute. It is also submitted that for the same date and place of occurrence, a case and counter-case have been lodged between the parties. The petitioners' side has filed Nokha P.S. Case No. 443 of 2024, while the informant's side has lodged Nokha P.S.
Patna High Court CR. MISC. No.39024 of 2025(2) dt.25-06-2025 3/3 Case No. 442 of 2024. Counsel further submits that the petitioners have clean criminal antecedents and are ready to fulfill all the conditions that may be imposed by this Hon'ble Court.
5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that the entire family has been made accused in the present case. However, he fairly submits that the criminal antecedents of all the petitioners are clean.
6. As such, in the present facts and circumstances of this case, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the satisfaction of A.C.J.M.-I, Rohtas at Sasaram, in connection with Nokha P.S. Case No. 442 of 2024, subject to the conditions as laid down U/s 482(2) of the BNSS, 2023.
