The petitioner seeks bail in Mahila P.S. Case No. 20 of 2016 registered under Section 498A of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. The petitioner happens to be the husband of the informant, who has been indicted with subjecting the informant to torture and cruelty for dowry demand along with other family members.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no

Patna High Court Cr.Misc. No.29353 of 2017 (2) dt.01-07-2017 2/2 offence. He has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner is ready to keep the victim with full dignity and honour. The petitioner has been languishing in custody since 28.01.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on provisional bail for two months on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Samastipur in connection with Mahila P.S. Case No. 20 of 2016. Both the parties are directed to appear before the learned Court below on 01.09.2017 and if the learned Court below satisfies itself that they are living peacefully and happily, should confirm the bail of the petitioner on that date itself.
