2. The petitioners have preferred this application for grant of regular bail in connection with Govindpur P.S. Case No. 116 of 2024 dated 09.04.2024 registered for the offences punishable u/s 30(a), 30(d) and 41 of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, total 120 litres of country made liquor and 1600 litres of fermented mahua were recovered.
4. Learned counsel for the petitioners have submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have no concern with the
Patna High Court CR. MISC. No.38490 of 2025(2) dt.23-06-2025 2/3 alleged recovery. Nothing has been recovered from the conscious possession of the petitioners. It is submitted that the name of the petitioners have transpired on the basis of confessional statement of apprehended co-accused person which has no evidential value in the eye of law. It is further submitted that alleged liquor was recovered from the jungle and bush situated on the bank of pain which is abandon place. Similarly situated co-accused persons have already been granted bail by the co-ordinate bench of this Court vide order dated 01.08.2024 passed in Cr. Misc. Nos. of 38348 of 2024 and 38868 of 2024 respectively. The petitioner no. 1 has two criminal antecedent and petitioner no. 2 one criminal antecedent as stated in para 3 of the bail petition. The petitioner no. 1 is in custody since 13.05.2025 and petitioner no. 2 is in custody since 06.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, in connection with Govindpur P.S.
