The petitioner is apprehending his arrest in connection with K. Hat (Maranga) P.S. Case No. 250 of 2015 registered for the offences punishable under Sections 409, 420, 467, 468, 471/34 of the Indian Penal Code.
The petitioner, being the Ex-Mukhiya, Gram Panchayat, Harda, in the capacity of Mukhiya has misappropriated the amount of Rs.1,20,000/- by withdrawing the same in the name of his father, mother and wife. Admittedly, the amount, in question, had to be given to the beneficiaries.
Learned counsel for the petitioner contends that without going into the merits of the case, the petitioner is willing and ready to deposit the aforesaid defalcated amount in the court below
Patna High Court Cr.Misc. No.31774 of 2015 (3) dt.04-11-2015 without prejudice his rights and subject to the outcome of the case in the Court below.
Considering the aforesaid stands taken by the petitioner and subject to deposit the aforesaid defalcated amount, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Purnia in connection with K. Hat (Maranga) P.S. Case No. 250 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
