The petitioner in the present case is seeking regular bail in connection with Kudra P.S. Case No. 39/2017, G.R. No. 519/17, registered for offences punishable under Section 379 of the Indian Penal Code and later on Section 411 IPC was added. Learned counsel for the petitioner submits that the First Information Report is against unknown for the alleged theft of a tractor of the informant together with a trolley. In course of search police has found one trolley bearing registration no. RB-24 G/5588 and one Bumper and Chhatri of tractor bearing registration no. BR-24 G/5579, on the basis of which the petitioner has been implicated. Submission of the petitioner is that he is innocent and

No.28165 of 2017 (2) dt.06-07-2017 2/2 the house from where these articles have been recovered is a joint family house where the petitioner along with many other members of the family is living. It is also submitted that the seizure is not in accordance with the provisions of the Code of Criminal Procedure, particularly one under Section 100 Cr.P.C. The petitioner is in custody since 12.03.2017 without there being any criminal antecedent.
Learned A.P.P. opposed the prayer for bail, however, in the facts and circumstances, considering the nature of allegations as also the period of custody, let the petitioner, namely, Munna Singh, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Kudra P.S. Case No. 39/2017, G.R. No. 519/17.
