JUSTICE SUDHIR SINGH ORAL ORDER 20-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 399, 402 of the I.P.C. and Sections 25(1B)a, 26(ii) and 35 of the Arms Act. Earlier the bail application of the petitioners was rejected vide Annexure-1 of the present application with the observation "at this stage". This is the second attempt for grant of bail on behalf of the petitioners.
It has been submitted on behalf of the petitioners that the petitioners are in custody since 3.8.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners. No arms is said to have been recovered from the possession of the petitioners.
Patna High Court Cr.Misc. No.53520 of 2016 (2) dt.20-12-2016 2/2 The other co-accused has been granted bail vide Cr.Misc.No.51211 of 2016.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur in connection with Hajipur Town P.S. case No.523 of 2016.
