JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-05-2015 It is stated at the Bar that petitioner No.2 has been arrested during the pendency of this application. This application for anticipatory bail, thus, dismissed so far it relates to petitioner No.2.

Heard learned counsel for the petitioners, learned counsel for the informant and learned Additional Public Prosecutor appearing on behalf of the State.

The petitioners seek anticipatory bail in a case registered for the offences punishable under sections 323, 324, 341, 326, 307, 354/ 34 of the Indian Penal Code. From the prosecution case, it appears that the occurrence took place on a petty dispute of serving jutha tea

Patna High Court Cr.Misc. No.46695 of 2014 (3) dt.14-05-2015 2/2 during Iftar party. Admittedly, there is case and counter with respect to the same occurrence.

In view of submissions, as above, the petitioners Nos. 1 and 3, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri, Deo Priya Kumar, learned Judicial Magistrate, 1st class, Begusarai in connection with Phulwaria PS Case No. 120/2014, subject to the conditions as laid down u/s 438(2) of the Code of Criminal Procedure.
