JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-05-2015 The petitioner is director of Aryan Agro Project India Ltd., Neutrant Food Project Ltd. and Aryan Holidays Private Ltd. He seeks anticipatory bail in a case registered for the offences punishable under sections 341, 323, 406, 420 of the Indian Penal Code and Section 27 of the Arms Act.
As per first information report, instituted under section 156(3) of the Code of Criminal Procedure, the informant had deposited certain amount with the company on the assurance that he will get high return after maturity period as detailed under the agreement, the details of which has been given in the complaint petition itself, which is the basis for institution of FIR. Pursuant to an observation made by this court on 07.05.2015, the petitioner himself is present. He has agreed to pay
Patna High Court Cr.Misc. No.46891 of 2014 (4) dt.14-05-2015 2/2 to the informant a sum of Rs. 4, 15, 500/- by way of final mutual settlement of the account between the informant and the Company by 25.06.2015, from his own account. Learned counsel for the petitioner has submitted that the amount so paid to the informant from his own account will be subject to adjustment of account with the concerned company. I need not comment on such submission.
In view of fair stand taken on behalf of the petitioner, let the petitioner, above named, if he surrenders within a period of one week from 25.06.2015, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount, each to the satisfaction of learned Sessions judge, Buxar in connection with Buxar (T) PS case No. 343/2014, subject to conditions as laid down u/s 438(2) of the Code of Criminal Procedure.
The petitioner shall be at liberty to take steps for compounding of the offence, if compoundable.
This application is allowed.
