JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of anticipatory bail arises out of Chakiya P.S. case No. 127 of 2014, disclosing offences under Sections 341,323,307,348 and 379/34 of the Indian Penal Code. Learned counsel for the petitioner appears to be right in his submission that no offence under Section 307 of the Indian Penal Code is made out against him as even if the prosecution case is treated to be true, he is said to have attempted to snatch the Laptop at the point of pistol which he admittedly did not use. In view of the submissions as above, this application for anticipatory bail is accordingly, allowed. Let the petitioner, above named, in
Patna High Court Cr.Misc. No.31832 of 2015 (2) dt.12-08-2015 the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sanjay Kumar Mishra, learned Judicial Magistrate, Ist Class, Matihari in Chakiya P.S. Case No. 127 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall liable to be cancelled.
