Earlier prayer for bail of the petitioner was rejected taking note of the allegation at initial stage of the case. Petitioner has remained in jail custody since 23.11.2015 and the report of the trial court goes to show that up till now, only two prosecution witnesses could be examined.

Considering the aforesaid facts and circumstances as well as the period of detention of the petitioner in jail custody and also taking note of the fact that the petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri R.K.Bharti, Judicial Magistrate, I st Class, Patnacity in Malsalami P.S. Case no. 261/2015.
