JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner seeks regular bail in connection with Parbatta (Maraiya) P.S. Case No.11 of 2017 registered for the alleged offences under Sections 25 (1-B) A, 26/27/27 of the Arms Act.

As per the prosecution case, the petitioner along with other accused persons resorted firing to establish their supremacy in the village and petitioner was apprehended with a loaded pistol and two live cartridges.

It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. He has been falsely implicated in this case. The allegations levelled against the petitioner are general and omnibus in nature. Nothing has been recovered from his conscious

Patna High Court Cr.Misc. No.29459 of 2017 (02) dt.01-07-2017 2/2 physical possession. He has been languishing in jail custody since 11.01.2017.

In the aforesaid facts and circumstances, I am not inclined to enlarge the petitioner on bail. However, the petitioner may renew his prayer for bail after framing of charge. Accordingly, this application is rejected.
