KUMAR ORAL ORDER 26-07-2019 On 24.07.2019, bail was granted to the petitioner, however, the case was again directed to be listed on 26.07.2019 under the heading 'To Be Mentioned' seeking some clarification from the learned counsel for the petitioner.
Heard learned counsel for the petitioner and learned counsel for the State.
Earlier bail application of petitioner was rejected by this Court in Criminal Miscellaneous No. 78647 of 2018 by order dated 01.02.2019, with a liberty to renew his prayer for bail after completing one year of custody. However, present petition has been filed before completion of one year on the ground that the matter has been compromised between the parties and Informant himself had appeared before the court below and had admitted the factum of compromise and
Patna High Court CR. MISC. No.37267 of 2019(2) dt.26-07-2019 2/2 submitted that he has no objection, if bail is granted to the petitioner.
Petitioner is in custody since 17.10.2018, in connection with Imamganj P.S. Case No. 136 of 2018 instituted under Sections 341, 323, 324, 325, 354B, 307, 380, 504, 506 r/w 34 of IPC.
It has been submitted that there was minor scuffle between the parties and Informant sustained injury as he fell down and his face hit the lower portion of the hand-pump and both parties are co-villagers and have amicably resolved their dispute and a joint compromise petition has also been filed in the court below.
In the facts and circumstances of the case, let the petitioner name above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Sherghati, Gaya, in connection with Imamganj P.S. Case No. 136 of 2018.
