2. The petitioner seeks bail in connection with Kesariya P.S. Case No. 99 of 2025 registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 303(2), 352, 351(2), 3(5) of BNS, 2023.
3. The petitioner has one criminal antecedent. He is a named accused in Kesariya P.S. Case No. 69 of 2025 under Sections 189(2), 115(2), 126(2), 117(2), 329(3), 351, 352(2) of B.N.S., 2023, in which the petitioner claims to be on bail.
4. The case of the prosecution, in brief, is that the informant gave a written application and as per the said application, on 14.03.2025 at about 5:00 P.M., when the

No.39632 of 2025(3) dt.13-08-2025 2/3 informant alongwith his brother was going on a motorcycle, Tuntun Sahani, Ajeet Kumar (petitioner), Priyanka Kumar, Paspati Devi stopped them and started abusing them. On protest, the accused persons assaulted them with lathi-danda and dab. The petitioner assaulted informant's brother with dab and while saving himself, he sustained injury on his right hand arm and blood started oozing out. The petitioner again assaulted him with dab, as a result of which, he sustained cut injury on his right hand hand. On hearing the noise, his brother Sebu Kumar came to rescue them, but the petitioner also assaulted him and while trying to save himself, three fingers of his left hand got cut. The accused-petitioner is also alleged to have snatched gold chain from the neck of the informant and his brother.
5. Learned counsel for the petitioner submits that the petitioner is innocent, has not committed any offence and has been falsely implicated in this case. The petitioner has one criminal antecedent and is in custody since 15.03.2025. He further submits that charge-sheet against the petitioner has already been filed and, therefore, his prolong custody is not required.
6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

From the perusal of the case diary, it transpires that there is serious allegation against the petitioner of having assaulted the informant and his brother with dab, due to which they have sustained injury resulting in chopping of three fingers of the brother of the informant. Needless to emphasize that the petitioner is the main assailant. Considering all these aspects of the matter and taking note of the gravity of the offence alleged to have been committed by the petitioner, at this stage, this Court is not inclined to grant the privilege of bail to the petitioner.
8. Accordingly, the present bail application stands rejected.
