The petitioner seeks bail in Sadar P.S. Case No. 100 of 2019, instituted for the offence under Section(s) 395 and 397 of Indian Penal Code.

Counsel for the petitioner submits that petitioner has no criminal antecedent. He has been implicated in the instant case on the basis of confessional statement of co-accused Ashish Kumar which was recorded by the Police in Sadar P.S. Case No. 242 of 2019. He further submits that there is no recovery of any incriminating article from possession of the petitioner. Petitioner is one of the guards who was employed in the Bank where the offence is alleged to have taken place.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur, in connection with Sadar P.S. Case No. 100 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
