JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-02-2017 The petitioner is in custody since 19.03.2016 in connection with Bettiah Town P.S. Case No. 66 of 2016, registered for offences punishable under Section 394 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner has not been named in the F.I.R, his name transpired in this during the course of investigation only on the basis of suspicion, however, nothing specific has come against this petitioner and he has been in judicial custody since 19.03.2016. It has further been submitted that though the petitioner is named in three other cases but in all other cases he is on bail. Heard learned A.P.P. also.

Having heard both sides, considering the aforementioned facts and circumstances, nature of offence and the period of custody and also that the nothing has come against this petitioner

Patna High Court Cr.Misc. No.2880 of 2017 (2) dt.10-02-2017 2/2 during investigation, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah Town P.S. Case No. 66 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court and other should be a Government official.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
