JUSTICE SUDHIR SINGH ORAL ORDER 26-10-2016 Heard learned counsel for the petitioners and the State. The petitioners are in custody in a case registered under Section 379 of the Indian Penal Code.

It is alleged by the informant that while he was traveling with his family from train, 8 to 10 unknown persons theft ornaments of about Rs. 4-5 lacs.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 01.07.2016. Charge sheet has been submitted in this case. The petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners are not named in the FIR. They have not been put on T.I. parade.There is no

Patna High Court Cr.Misc. No.37068 of 2016 (3) dt.26-10-2016 2/2 recovery of any incriminating article from their possession. Except for the confessional statement, there is no other substantive evidence to suggest the implication of the petitioners in the present case.

On behalf of the State, it has been submitted that the petitioners are not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Bhagalpur in connection with Bhagalpur (Rail) P.S.Case No.84 of 2015 (G.R.No. 84/15).
