06-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Kasma P.S. Case No. 29/2016 registered for the offence punishable under Sections 147, 148, 149, 341, 386, 387, 435, 427, 353, 504, 506 of the Indian Penal Code and Section 17 of C.L.A. Act.
Learned counsel for the petitioner submits that as per the First Information Report there is a vague and omnibus allegation against some unknown persons who allegedly raised the slogans and set the mixture machine on fire. Learned counsel however submits that
Patna High Court Cr.Misc. No.28420 of 2017 (2) dt.06-07-2017 the name of the petitioner has transpired in the confessional statement of co-accused Bira Das and Awadhesh Thakur. However, both of them have been granted regular bail by a coordinate Bench of this Court vide Cr. Misc. No. 2853/2017 and Cr. Misc. No. 2776/2017, placed at Annexure 2(B) and 2(C) respectively.
Learned counsel for the petitioner further submits that till date no test identification parade has been conducted and the charge-sheet has already been submitted.
However, learned A.P.P. for the State opposes the prayer for bail.
Considering the facts and circumstances of the case, though this petitioner is an accused in five other cases, in similar situation a coordinate Bench of this Court has granted regular bail to the co-accused, hence, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad, in connection with Kasma P.S. Case No.
Patna High Court Cr.Misc. No.28420 of 2017 (2) dt.06-07-2017 29/2016, subject to the same terms and conditions which are mentioned in Cr. Misc. No. 2853/2017, and are reproduced hereunder : - "(i) One of the bailors of the petitioner shall be a government servant and the other bailor should also have sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail."
