1. Heard Mr. Shiv Prasad Gupta, learned counsel for the petitioner and Mr. Sanjay Kumar Pandey, learned APP for the State.
2. The petitioner seeks regular bail in connection with Koilwar P. S. Case No. 486 of 2021, dated 07.10.2021 registered for the offence punishable under Section 395 of the Indian Penal Code.
3. The main submissions advanced by the petitioner's counsel are that the instant matter relates to snatching of motorcycle and a mobile phone of the informant by five unknown accused, who allegedly committed the act by putting the informant in fear by showing him a pistol but against the
Patna High Court CR. MISC. No.39208 of 2025(2) dt.04-07-2025 2/3 petitioner there is no admissible evidence to show his involvement in the alleged crime of dacoity. It is further submitted that the petitioner has been made accused mainly on the basis of confessional statement of co-accused Sunil Kumar with whom the petitioner has inimical terms and the said coaccused has been granted bail by a co-ordinate bench of this court vide order dated 30.08.2022 passed in Cr. Misc. No. 19221 of 2022 and one another co-accused Indal Yadav has also been granted bail by a co-ordinate bench of this court vide order dated 05.08.2022 passed in Cr. Misc. 30520 of 2022. It is lastly submitted that the petitioner has been languishing in jail since 22.03.2025 and against him the investigation has been completed and he was not put on test identification parade after he was taken into custody and the alleged looted mobile phone and motorcycle were not recovered from his possession.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the aforesaid submissions advanced by the petitioner's counsel, this court is inclined to grant the relief of bail to the petitioner. Accordingly, let the petitioner namedabove be enlarged on bail in connection with Koilwar P. S. Case No. 486 of 2021 on furnishing bail bond of Rs. 20,000/-
Patna High Court CR. MISC. No.39208 of 2025(2) dt.04-07-2025 3/3 (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
