JUSTICE RAKESH KUMAR ORAL ORDER 24-10-2016 Heard Sri Gagandeo Yadav, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 19.05.2016 in Jai Nagar P.S. Case No.289 of 2015 registered for the offence under Sections 302,201/34 of the Indian Penal Code, has prayed for grant of bail.
By way of referring to F.I.R., it was submitted by learned counsel for the petitioner that only on suspicion, the petitioner has been made accused along with others. He further submits that two accused persons, almost on similar accusation, have already been granted bail by a Bench of this Court vide Cr.Misc.No.30886 of 2016. He submits that the petitioner has no concern with the alleged occurrence.
Besides hearing learned counsel for the parties, I
Patna High Court Cr.Misc. No.45700 of 2016 (2) dt.24-10-2016 2/2 have also perused the material on record. Keeping in view the fact that other accused persons, almost on similar accusation, have been granted bail as well as on perusal of the F.I.R. which indicates suspicion, there is no reason to deny the prayer for extending the privilege of bail to the petitioner. Accordingly, let the petitioner, namely, Chalitar Thakur @ Ram Chalitar Thakur be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Madhubani in connection with Jai Nagar P.S. Case No.289 of 2015.
