Petitioner is not named in the First Information Report but in course of investigation, the name of petitioner came in the confessional statement of co-accused and on the basis of confessional statement, petitioner was remanded in this case from another case but admittedly, nothing has been recovered from the conscious possession of the petitioner nor petitioner has been put on test identification parade though he is languishing in jail custody since 28.06.2016. The investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten
