====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 14-08-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Gopalpur P.S. Case No. 32 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Informant in his ferdbeyan alleged that on 08.03.2018 he along with his family member including his son Bullet Sah had gone to attend a marriage ceremony and after sometime informant and his family members returned, leaving his son in the marriage. In the morning, he found that his son did not return. During course of search, he got information that the dead body of his son was lying in the field. It is submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.34147 of 2018(3) dt.14-08-2018 2/2 petitioner has no concern with the aforesaid offence. He has been falsely implicated in this case. The FIR was lodged against unknown but only on the basis of confessional statement made before the police by co-accused persons, the petitioner has been roped in this case. Similarly situated co-accused, namely, Mukesh Kumar Yadav and Mankeshwar Prasad & another have been granted bail by another coordinate Bench of this Court in Cr. Misc. No. 32543 of 2018 and Cr. Misc. No. 27712 of 2018 vide order dated 09.07.2018 and 23.05.2018 respectively. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIth, Gopalganj in connection with Gopalpur P.S. Case No. 32 of 2018.
